HB 5099 Suggested Changes – Out-of-Network Incentives and Cash-Only Mandates Risk Quality and Affordability

TAHP opposes key provisions in House Bill 5099 that extend incentive payments to out-of-network providers and mandate unlimited cash rewards to patients. These requirements would force a costly restructuring of EPO and HMO plans, undermine network quality standards, and expose patients to balance billing and tax consequences. No other state has adopted such a mandate. Instead of a rigid cash-only model, lawmakers should promote a range of shared savings tools—like reduced cost sharing or HRA contributions—within existing in-network structures.
