Recommendations:

• Understand that AI can significantly streamline administrative tasks. Prior authorization approvals can be handled immediately. However, denials continue to protect patients through strict “human-in-the-loop” requirements that require physician feedback.
• Ensure that any new legislation does not conflict with or duplicate existing regulations.
• Consider a risk-based framework that can evaluate AI on a case-by-case basis.
• State insurance regulators are best positioned to create AI rules that are targeted to the needs of this sector.
• Third-party vendors should be held accountable for adhering to insurers’ AI-related policies and standards.
